PARKING RULES AND REGULATIONS: 1. Parking Rights: Property Owner permits the Organization listed above by Applicant to utilize the Parking Facility conditioned on the timely payment of parking fees and any additional charges that may be due. Organization has extended to Applicant the privilege to utilize the Parking Facility. Applicant must comply with these Parking Rules and Regulations, as amended from time to time by Property Owner. Property Owner reserves the right to terminate Applicant’s parking privileges for any reason, in its sole discretion, including the failure of Organization to pay amounts when due or violation of these Parking Rules and Regulations by Applicant. 2. Non-Assignability: Applicant may not transfer, assign or resell a Parking Credential and its associated access and privileges. If Organization allows Parking Credentials to be internally transferred between individuals, then each individual using a Parking Credential must complete and submit this application to the Parking Operator before using the Parking Facility. 3. Parking Credential: One (1) Parking Credential will be issued upon Applicant's (i) submission of a completed and signed copy of this application, and (ii) payment of parking fees and any additional charges by Organization. The Parking Credential may be used only in accordance with these Rules and Regulations, and at all times remains the property of the Property Owner. 4. Monthly Parking Fees: Monthly parking fees are established by the Property Owner in consultation with the Parking Operator and are subject to change. Monthly parking fees cannot be prorated or otherwise adjusted for periods during which the Applicant does not use parking privileges. The monthly parking fee must be paid by Organization prior to the first day of the month to which it applies, or Applicant’s parking access will be suspended until payment has been made. 5. Use of the Parking Facility: Property Owner may amend these Parking Rules and Regulations from time to time. Applicant must comply with these Parking Rules and Regulations, as amended from time to time, and other applicable laws and regulations, and shall follow safe driving practices at all times while in the Parking Facility. Failure to comply with these requirements will result in the termination of Applicant’s parking access. 6. Permitted Use: Only registered and insured motor vehicles having a maximum height no greater than the maximum height posted, and of such length and width such that it fits within a conventional parking space, are permitted in the Parking Facility. Parking Operator reserves the right to inspect Applicant’s evidence of registration and/or insurance, at any time, for any vehicle seeking to use the Parking Facility. In no event will trailers, be allowed in the Parking Facility. Parking Facility may not be used for parking commercial vehicles or as a staging area for commercial transportation, delivery, or other services, except with Parking Operator’s prior written consent. 7. No Storage, Abandonment: Parking Facility may not be used for storage of vehicles or other equipment. Any vehicle or equipment remaining in Parking Facility for more than fourteen (14) consecutive calendar days shall be deemed abandoned and may be removed from the Parking Facility (Parking Operator will endeavor, but is not required, to send notification to the Applicant three (3) days before removal). Neither Property Owner, Property Manager, nor Parking Operator shall have any liability to any person for loss or damage on account of such removal. All costs incurred in removing and storing any such abandoned vehicle or equipment shall be reimbursed by Applicant upon being billed therefore by Parking Operator. 8. Prohibited Activities: Prohibited activities at the Property and in the Parking Facility include, but are not limited to, the below list whether they occur inside or outside of a vehicle. a. Unpermitted use of parking spaces that are marked for specific classes – reserved, accessible, electric vehicle charging, carpooling, etc. b. Driving in excess of 5 miles per hour. c. Utilizing area outside parking stripes including over-sized vehicles using compact-sized spaces and using multiple parking spaces for a single vehicle. d. Blocking or double-parking other vehicles or hindering traffic lanes. e. Idle vehicle engine for longer than three (3) minutes. f. Conduct vehicle repairs except for repairs of an emergency nature (i.e. flat tire, broken windshield, battery jump-start). g. Use Parking Facility water source and/or cleaning/washing/detailing vehicle without Parking Operator’s permission. h. Charge electric vehicles from a power source in the Parking Facility other than a designated charging station. i. Smoke, vape or use of e-cigarettes. Includes tobacco, marijuana, or other inhaled/exhaled substances and products. j. Drink alcohol or consume drugs. k. Cook, prepare, serve and/or consume food and drink. l. Dispose or store any trash, waste, personal property, or hazardous materials. m. Leave pets within vehicles. n. Create excessive or offensive noise or disturbance (i.e. music, shouting, engine revving). o. Commit acts of vandalism, malicious damage or attempt trespass to restricted areas. p. Failure to report damage caused to another vehicle. q. Other activities not directly associated with short-term parking of a vehicle within Parking Operator’s discretion (i.e. event tail-gating, sleeping, loitering, racing). 9. No Liability of Property Owner, Property Manager, or Parking Operator: Applicant is granted a license to park only, and no bailment is intended or shall be deemed created. To the fullest extent permitted by law, neither Property Owner, Property Manager, nor Parking Operator, nor their respective officers, directors, beneficiaries, agents, employees, successors and assigns, shall be responsible or liable to any extent for (i) damage to or theft of any vehicle or its contents due to fire, collision, vandalism or any other cause, (ii) injuries or liabilities suffered by any person while using the Parking Facility; or (iii) any losses or other damages incurred by any party by reason of that party's inability to use the Parking Facility. I understand and agree to fully comply with the above Parking Rules and Regulations at the Parking Facility as the same may be modified from time to time.
