UNDERGROUND DONUT TOUR, LLC PARTICIPANT AGREEMENT, WAIVER AND RELEASE FORM In consideration of being permitted by Underground Donut Tour, LLC, an Illinois limited liability company (“UDT LLC”), to participate in the walking tour of doughnut stores in the location which I am booking through this site (the “Tour”) provided by UDT LLC, on behalf of myself and all those for whom I have purchased tickets, we hereby waive, release and discharge any and all claims for damage for personal injury, death or property damage which any of us may have, or which may hereafter accrue to me, as a result of participation in the Tour. This release is intended to discharge in advance UDT LLC, its members, managers, employees, and agents from any and all liability arising out of or connected in any way with my participation in the Tour even though that liability may arise out of negligence or carelessness on the part of those parties. It is understood that activities such as the ones we will be participating in involve an element of risk and danger of accidents and knowing those risks, we hereby assume those risks. It is further agreed that this waiver, release and assumption of risk is to be binding on our heirs and assigns. We agree to indemnify, defend and to hold harmless, UDT LLC, its members, managers, employees and agents from any loss, liability, damage, cost (including but not limited to attorneys’ fees and costs) or expense which they may incur as the result of the death or any injury or property damage that we may sustain while participating in the Tour. We further acknowledge that anything we eat or drink during or as a result of the Tour is at our sole risk. We hereby consent to photo images taken by the UDT LLC staff during the Tour to be used in any or all UDT LLC publications and websites. CONSENT OF PARENT/GUARDIAN (If Participant is a minor) I am the parent or legal guardian of any minor Participant listed above. I hereby consent that the Participant may participate in activities at this Tour and I hereby execute this Agreement, Waiver and Release on his/her behalf. I hereby affirmatively state that the said Participant is physically able to participate in said activity. I hereby agree to indemnify and hold the persons and entities mentioned above free and harmless from any loss, liability, damage, cost (including but not limited to attorneys’ fees and costs) or expense that they may incur as result of the death or any injury or property damage that said Participant may sustain while participating in activities at any such tour. I HAVE CAREFULLY READ THIS AGREEMENT, WAIVER AND RELEASE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND IS A CONTRACT BETWEEN ME AND UDT LLC AND I SIGN IT OF MY OWN FREE WILL. I HAVE OBTAINED THE AGREEMENT OF ALL PARTICIPANTS FOR WHOM I HAVE PURCHASED TICKETS.
