If you have an account, there are several ways you can receive Groupon Bucks. You can earn Groupon Bucks by participating in various promotional activities and responding to certain offers (“Promotional Activity”). Groupon may also issue Groupon Bucks to your account for refunded purchases, or for other reasons within its discretion; or you may purchase Groupon Bucks in various increments on Groupon gift cards.
- Promotional Activity. In order to earn Groupon Bucks indicated in the Promotional Activity materials, you must comply with the terms of the applicable Promotional Activity. Groupon may issue Groupon Bucks to your account directly or provide you with a promotional code valid for a certain amount of Groupon Bucks. If Groupon issues the Groupon Bucks directly to your account and a Promotional Activity must be validated, Groupon Bucks may not appear in your account for up to ten (10) business days. Promotional codes, valid for a certain amount of Groupon Bucks, are governed by the terms and conditions disclosed on or distributed with the specific promotional code.
- Refunds. Groupon Bucks received as a refund of the amount you pay will be added to your account by Groupon. Groupon Bucks received as a refund of the amount you pay do not expire.
- Groupon Gift Cards. Groupon Bucks acquired through Groupon gift cards are governed by the terms and conditions disclosed on or distributed with the specific gift card. Groupon Bucks acquired through your use of a Groupon gift card may expire in accordance with applicable law.
You are responsible for ensuring that Groupon Bucks you earn, purchase or are awarded as credits are added to your Groupon account. If you have Groupon Bucks in your account, the Groupon Bucks will automatically be the first form of payment applied to your future Groupon purchases made through your account. If you make a purchase through the guest checkout feature of the Site, you will not be able to apply any kind of Groupon Bucks to your purchase.
Groupon’s Refer-a-Friend program (“RAF Program”) is a Promotional Activity by which you may earn Groupon Bucks if a non-Groupon customer you refer becomes a Groupon customer and makes a qualifying purchase on the Site. You may earn up to a maximum of $100 in Groupon Bucks over the lifetime of your participation across all referrals (“Lifetime Program Limit”). In order to be eligible to earn Groupon Bucks through the RAF Program, you must be eligible to accumulate and redeem Groupon Bucks, maintain a Groupon account in good standing and be under the Lifetime Program Limit.
To participate, refer friends who are not current Groupon subscribers and who have never purchased a Voucher from the Site (“New User”) by sending them your personal referral link (“Unique Link”), available on the Site or provided to you as a recipient of an invite-only special offer. For a New User who accesses your Unique Link and, within the following seventy-two (72) hours (i) registers on the Site, and (ii) makes an initial purchase of a Groupon offer priced at ten dollars ($10) or more (“Eligible Offer”), Groupon will, within a reasonable amount of time, post to your account any Groupon Bucks you are eligible to receive, up to the Lifetime Program Limit.
Groupon reserves the right at any time to modify or discontinue the RAF Program, either temporarily or permanently (or any part thereof), with or without notice. Groupon will not be liable to you in the event of any modification, suspension or discontinuance of the RAF Program.
In addition to Coupons offered throughout the Site generally, a portion of the Site is also dedicated to Coupons. It makes available digital and printable Coupons. All content located within this portion of the Site consists of Merchant or third party content not endorsed or recommended by Groupon. You understand that Groupon: (i) does not and cannot review the content made available on this portion of the Site; (ii) Groupon does not validate or guarantee any of the content made available on this portion of the Site; and (iii) Groupon is not a party to any transaction you make on a Merchant’s site or third party site.
Consent to Transaction Monitoring.
By registering your payment card in connection with Groupon+ or any other card-linked deals (as defined below), you accept and agree: (i) to these terms and any other terms, conditions and restrictions set forth in the applicable card-linked deal on the Site and these terms and conditions, as they may be amended from time to time (collectively, the “Groupon+ Deal Terms”); and (ii) that the Payment Services Provider may monitor your Linked Card transactions at all Groupon+ Merchants to identify Qualifying Transactions and provide transaction information to us for use as described below, and initiate and process statement credits as requested by us in connection with Rewards. In addition, you authorize and agree to receive targeted, complementary and/or location-based offers in real-time when you redeem an offer with a Merchant. Such offers may be presented via email, push notifications, within the Site, and through ads on other sites and mobile applications that may be served by Groupon and third parties, including Groupon’s advertising partners.
A “card-linked deal” is an offer of a Reward from a participating Merchant that is available on the Site, redeemed with the Merchant using your Linked Card (as defined below), and may be branded Groupon+. Card-linked deals take various forms as described on the Site, which may change from time to time. Some offers require you to “claim” a specific merchant offer (which action may be referred to on the Site, alternatively, as “unlock”, “activate”, “get”, “access”, “add to card” or other similar term), some may require an upfront payment, and in some cases, you may be enrolled in offers that are valid across multiple merchants without needing to claim an offer at each individual merchant.
A “Qualifying Transaction” is a purchase from a Merchant in connection with a claimed, enrolled, or paid-for card-linked deal made with a Linked Card that, in Groupon’s sole discretion, satisfies all of the Groupon+ Deal Terms.
A “Reward” is the amount offered to you in connection with a Qualifying Transaction, either as cash back (issued as a credit on your Linked Card monthly statement), as Groupon Bucks, or in another form as described in connection with the applicable card-linked deal. Unless otherwise advertised in connection with a card-linked deal or the card-linked deal requires an upfront payment to claim, the maximum Reward per Qualifying Transaction is equal to $150 in value.
Overview. As more fully explained below, to participate in a card-linked deal and receive Rewards, you first register your Eligible Payment Card (as defined below, and once registered, your “Linked Card”) and where required based on the type of card-linked deal, claim or pay for the card-linked deal(s), and then use your Linked Card to make Qualifying Transactions during the redemption period. When you make a transaction for a card-linked deal, you pay the full purchase price at the time of your transaction and, after your purchase has been confirmed as a Qualifying Transaction, your Reward will be provided to you, either as a credit applied to an upcoming statement for your Linked Card, as Groupon Bucks, or in another form as described in connection with the applicable card-linked deal.
Your Linked Card(s) will be automatically linked to each card-linked deal you are eligible for – i.e., all deals that you have claimed or paid for (where claiming or payment is required), as well as all deals where specific claiming is not required, like many Groupon+ deals – and your card will remain linked until you un-link such Linked Card from a deal, revoke consent for such Linked Card, or remove such Linked Card from your Groupon customer account. Groupon may, in its sole discretion, extend the redemption period for certain card-linked deals or automatically re-claim deals that don't require upfront payment on your behalf on a rolling basis. You may un-link a claimed or paid-for deal from a Linked Card at any time by contacting Groupon Customer Support. You may revoke consent or add or remove Linked Cards and withdraw or terminate your participation in the Groupon+ deals program in your Groupon Customer Account.
The Merchant is fully and solely responsible for the care and quality of all goods and services it provides to you and for any and all injuries, illnesses, damages, claims, liabilities and costs (“Liabilities”) it may cause you to suffer, directly or indirectly, in full or in part, whether related to the use or redemption of a card-linked deal or not. You waive and release Groupon and its subsidiaries, affiliates, partners, officers, directors, employees and agents from any Liabilities arising from or related to any act or omission of a Merchant in connection with your use or redemption of a card-linked deal or the goods, services or experiences a Merchant provides in connection with the card-linked deal.
Upfront Payments. For a card-linked deal that requires an upfront payment to claim, the amount paid to Groupon is an unlock fee to access that specific card-linked deal for the redemption period. The unlock fee paid to Groupon is non-refundable.
Calculation of Rewards. Unless otherwise stated in connection with the applicable card linked deal, the Reward will be calculated based on the entire amount remitted to a Merchant for each Qualifying Transaction, including tip (if any), up to any stated maximum amount of possible Rewards, if applicable (the “Reward Cap”). If the card-linked deal states that the Reward is based on the pre-tip amount remitted to a Merchant for each Qualifying Transaction, such pre-tip amount will be determined by using the lesser of the transaction authorization and settlement amounts. In connection with some deals, Rewards will be awarded at the high percentage or set amount, as specified on a deal page, for the first Qualifying Transaction and at the low percentage or set amount, as specified on a deal page, for each subsequent Qualifying Transaction, even if the deal is re-claimed or the redemption period is extended.
Eligible Payment Cards and Qualifying Transactions. An “Eligible Payment Card” is a U.S.-issued Visa, Mastercard, or American Express credit or debit card (subject to limitations with debit card transaction eligibility noted below). Some Visa, Mastercard, and American Express cards are not Eligible Payment Cards including, without limitation: Visa or Mastercard Corporate cards, some American Express corporate cards, Visa, Mastercard or American Express Purchasing cards, certain types of American Express cards issued by financial institutions other than American Express, non-reloadable prepaid cards, government-administered prepaid cards (including EBT cards), healthcare cards (including Health Savings Account (HSA) or Flexible Spending Account (FSA) cards), insurance prepaid cards and Visa Buxx. You agree to at all times provide accurate and complete information to Groupon. You must be the cardholder on the account or an authorized user of the Linked Card to claim or redeem a card-linked deal. If a Linked Card is no longer valid or is lost or stolen, or if you receive a replacement card with a different account number or expiration date, you must log into your Groupon account and add or update the card details on file in order to receive Rewards in connection with any card-linked deals.
Credit card transactions can generally be monitored to identify Qualifying Transactions, and most – but not all – Visa Mastercard, and American Express debit card transactions will be eligible for statement credits if run as “credit” transactions (i.e., you use a signature, not your Personal Identification Number (“PIN”), to complete the applicable Qualifying Transaction). The following purchases will not be treated as Qualifying Transactions (and you will not be awarded Rewards for these purchases): (i) if you use a PIN when paying with your Linked Card; (ii) any transaction that is not directly processed or submitted through the Visa U.S.A., Mastercard, and American Express payment systems, as applicable; and (iii) any purchase a Payment Service Provider (as defined below) is unable to monitor (including purchases you initiate through identification technology that substitutes for a PIN and transactions made through a payment method such as a digital wallet or a third party payment product where your Linked Card is a funding source but you do not present your Linked Card directly to the Merchant). As between you and Groupon, the determination as to what transactions are Qualifying Transactions shall be made by Groupon in its sole discretion.
In order to receive a Reward, Groupon may require you to provide a receipt of your purchase from the Merchant for a Qualifying Transaction. You are responsible for all applicable taxes that apply to you, a claimed, purchased or enrolled card-linked deal and any purchases with a Merchant. Unless otherwise stated in the Groupon+ Deal Terms or required by law, there is no cash value for any goods or services associated with a card-linked deal.
Statement Credits. If the Reward associated with a card-linked deal is cash back in the form of a statement credit, you agree that the Payment Services Provider may initiate and process statement credits as requested by Groupon.
Statement credits will not appear or be reflected on your transaction receipt from the Merchant at the time of purchase, and will instead be reflected on your periodic Linked Card statement. Subject to eligibility verification and settlement of the Qualifying Transaction, statement credits will typically appear on your Linked Card statement approximately 5 days after the final Qualifying Transaction, but may be subject to delays. If you do not receive your statement credit, please contact us, in which case the value of your statement credit may be issued to you in the form of Groupon Bucks or another form of reward. Statement credits may constitute taxable income to you. Compliance with any applicable tax requirements is your responsibility. Statement credits cannot be processed if your Linked Card number expires or changes while statement credit is pending and not settled, or your Linked Card account is not open or in good standing. We will notify you of a statement credit. You may not receive the value associated with the Reward if the applicable issuer does not post the statement credit. Groupon, the Payment Service Provider and your issuer will have no responsibility or liability for the failure of a statement credit to be posted. Neither Groupon nor the Payment Service Provider is responsible for any finance or other charge, or impact on any rewards, feature, or term of your account resulting from the statement credit; your Linked Card issuer is responsible for all such charges or impacts.
In no event shall any Payment Service Provider constitute or be considered as maintaining any type of financial obligation or deposit or other asset account, or holding funds or other value for you for distribution to you. Any pending statement credits and any associated dollar values represent offer fulfillment amounts in process owed by the Merchant, and not your funds or balances maintained or held by a Payment Service Provider or Groupon.
Third Party Monitoring and Transaction Data. Your transactions at participating Merchants will be monitored by the applicable Eligible Payment Card issuer, payment network or platform, or third party authorized by an Eligible Payment Card issuer or payment network or platform (each, a “Payment Services Provider”). This means that Groupon will notify the applicable Payment Services Provider when you have claimed, enrolled in, or paid for a card-linked deal and provide your Linked Card number to the Payment Services Provider, and the Payment Services Provider will notify Groupon when it identifies, and provide details of, a Qualifying Transaction. You authorize Groupon and the relevant Payment Services Provider to provide such notifications and engage in such monitoring.
You understand and agree that Groupon will access and use data about Qualifying Transactions made by you with participating Merchants. You agree that Groupon may use the transaction data to:
- confirm a Qualifying Transaction or return made by you at a participating Merchant;
- confirm whether you qualify for a Reward;
- share transaction data with a participating Merchant to confirm whether a specific transaction has occurred;
- create a record of the transaction data to verify and maintain a record of your purchases;
- provide participating Merchants reports concerning activity as it relates to card-linked deals;
- provide you with targeted offers for products and services from us and/or Merchants;
- perform analytics regarding the performance of card-linked deals;
- communicate with you concerning transactions and provide general customer service and respond to your inquiries; and
- respond to legal, regulatory and audit requests and resolve disputes and defend claims against or by Groupon concerning card-linked deals.
In addition, you agree that Groupon may use the transaction data in accordance with the Groupon Privacy Statement in ways that are consistent with the above. You authorize the sharing, exchange and use of transaction data in connection with your enrolled, claimed, paid for and redeemed card-linked deals by and among Groupon, Groupon’s third party service providers, applicable Payment Service Providers and applicable Merchants, as described herein and in the Groupon Privacy Statement in ways that are consistent with the above.
