Designed to avoid the need for probate, this package contains the documents and legal advice to help couples plan for needs at the end of their lives and after their deaths. A 30- to 45-minute phone consultation with attorney Tony Bayard de Volo kicks off the process. Then he sends you off a simple “sign up data form” with cover letter that explains how trusts work. Fill out the form, send it back, and call to schedule the signing. Clients can call with questions or to discuss trust concerns with him personally any time. Documents are completed within 30 days of the initial consultation and all subsequent consultations take place face-to-face or over the phone, depending on convenience.
This package will ensure the following documents are created properly:
- Revocable family living trust
- Wills for each spouse
- California medical directive and power of attorney for each spouse
- Grant deeds for one or two properties, so that they may be placed in the trust (additional properties are $50 each)
• Preliminary Change of Ownership form
- Cover letter explaining how the trust works
County Recorder Filing Fees (about $30 a deed) and Notary Charges ($40-$80 for a typical married couple) are charged separately by those vendors.
This deal is valid for all California residents with estates that have a gross value of $5 million or less, regardless of location. For clients who can not meet to sign at the San Jose office, Attorney de Volo will send the completed Trust Book indicating where to sign and notarize.
